By using this website, contacting Valley Arbor Care, requesting an estimate, accepting a proposal, or scheduling services, you agree to these Terms and Conditions. If you do not agree with these terms, please do not use this website or proceed with services.

These Terms and Conditions are intended to help set clear expectations between Valley Arbor Care and its customers. They are not a substitute for any written proposal, invoice, service agreement, or other specific agreement provided for a particular job. If there is a conflict between these general Terms and Conditions and a written proposal or agreement for a specific project, the written proposal or agreement will control that project.

Services Offered

Valley Arbor Care provides tree care and related outdoor services, which may include tree removal, tree pruning, land clearing, firewood, emergency tree services, storm damage response, and other related services. The exact services to be performed for a customer will be described in the applicable estimate, proposal, invoice, or written communication.

Services may vary based on site conditions, access, weather, safety considerations, equipment requirements, and the scope of work agreed upon with the customer. Valley Arbor Care reserves the right to decline, postpone, modify, or stop work if conditions are unsafe, inaccessible, materially different from what was originally understood, or otherwise unsuitable for the planned service.

Estimates, Proposals, and Scope of Work

Any estimate or proposal provided by Valley Arbor Care is based on the information available at the time it is prepared, including visible site conditions, customer-provided details, and the requested scope of work.

Unless otherwise stated in writing, estimates and proposals may be subject to change if hidden conditions, additional hazards, access limitations, utility concerns, property line issues, changes requested by the customer, or other factors are discovered before or during the work.

Examples of conditions that may result in additional charges include hidden decay, storm damage, unstable trees or limbs, limited access, utility concerns, nearby obstacles, debris outside the original scope, or customer requests that go beyond the approved proposal.

Deposits and Payment Terms

Valley Arbor Care does not currently require deposits before starting work unless a specific written proposal states otherwise.

Payment is due within 30 days from invoicing, unless different payment terms are stated in writing for a specific project. Customers are responsible for paying all amounts due for approved services, including any agreed-upon additional work, materials, disposal, hauling, equipment, or other charges described in the applicable proposal or invoice.

Valley Arbor Care reserves the right to pause future work, decline additional services, or take appropriate collection steps for overdue invoices. Any late payment terms, finance charges, collection costs, or related fees will apply only to the extent stated in the applicable invoice, proposal, or permitted by law.

Scheduling, Rescheduling, and Weather Delays

Tree care and outdoor work can be affected by weather, emergency calls, equipment availability, site conditions, crew safety, and other unforeseen circumstances. Valley Arbor Care reserves the right to reschedule work based on weather conditions or any other unforeseen circumstances.

Customers are responsible for ensuring the property is ready and accessible on the scheduled service date. If the crew cannot safely access the work area or complete the agreed-upon work because of blocked access, locked gates, pets, vehicles, debris, unmarked hazards, or other customer-controlled conditions, the work may need to be rescheduled and additional charges may apply.

Customer Responsibilities Before Work Begins

Before work begins, customers are responsible for providing accurate information about the property, the requested work, and any known hazards or limitations. This may include identifying property lines, underground utilities, septic systems, irrigation systems, invisible fencing, landscaping, lighting, drainage, buried cables, nearby structures, and any other items that could be affected by tree work or equipment.

Customers are also responsible for securing pets, moving vehicles and personal property, unlocking gates, arranging access, notifying neighbors when needed, and obtaining any required permissions from property owners, landlords, homeowners associations, municipalities, or other relevant parties.

Valley Arbor Care is not responsible for delays, added costs, disputes, or damage resulting from inaccurate information, lack of access, unmarked hazards, disputed property lines, or permissions the customer was responsible for obtaining.

Property Access and Work Areas

Tree service work often requires access for crews, vehicles, trailers, chippers, loaders, stump grinders, and other equipment. Customers authorize Valley Arbor Care and its crew members to enter the property as reasonably necessary to perform the agreed-upon services.

Customers understand that certain work may require access across lawns, driveways, gravel areas, landscaped areas, or other portions of the property. Valley Arbor Care will make reasonable efforts to work carefully and minimize disturbance, but outdoor service work and heavy equipment may affect lawns, driveways, turf, soil, mulch, landscaping, or ground conditions.

Safety and Active Work Zones

Tree removal, pruning, storm cleanup, land clearing, and related services can be hazardous. Active work zones may involve falling limbs, moving equipment, saws, ropes, rigging, trucks, chippers, and other dangerous conditions.

For safety, customers, residents, children, pets, neighbors, and visitors must stay away from active work areas and follow crew instructions while work is underway. Customers should not enter the work zone, move cones or barriers, approach equipment, or attempt to assist unless specifically directed by Valley Arbor Care.

Valley Arbor Care may stop or delay work if anyone enters the work area, creates an unsafe condition, or fails to follow safety instructions.

Liability, Property Conditions, and Damage Disclaimer

Valley Arbor Care will use reasonable care while performing agreed-upon services. However, customers acknowledge that tree care and outdoor work involve inherent risks, especially near structures, fences, utility lines, landscaping, driveways, lawns, neighboring properties, unstable trees, storm-damaged trees, deadwood, or hidden defects.

Valley Arbor Care is not responsible for pre-existing conditions, hidden conditions, natural tree failure, storm-related damage, underground or hidden items not disclosed or marked by the customer, or damage caused by conditions outside the company’s reasonable control.

Tree health and stability can change over time. No statement by Valley Arbor Care should be understood as a guarantee that a tree will remain healthy, safe, stable, or free from future storm damage, disease, decay, limb failure, or other natural risk unless a specific written guarantee is provided.

Cleanup, Debris, Logs, and Stump Grinding

Cleanup is dependent on the scope of work and what is agreed upon with the customer and Valley Arbor Care staff. The applicable proposal, estimate, or written communication should describe whether debris removal, hauling, log removal, firewood cutting, branch cleanup, raking, stump chips, or related cleanup is included.

Unless specifically included in the agreed scope of work, cleanup may not include removal of all wood, logs, stump grindings, chips, sawdust, leaves, disturbed soil, or small debris. Customers should confirm any desired cleanup expectations before approving the work.

Stump grinding is always a separate line item and is not automatically included with tree removal unless specifically listed in the approved proposal or invoice. Stump grinding may leave wood chips, grindings, surface disturbance, roots, or uneven ground. Backfilling, grading, topsoil, seeding, landscaping, or removal of stump grindings should be discussed separately if desired.

Emergency Services

For emergency service requests, Valley Arbor Care will assess the site conditions and the nature of the damage. Emergency work generally requires an on-site assessment of the damage and a written proposal before the commencement of any work.

Emergency response timing may depend on crew availability, weather, safety conditions, road access, severity of the situation, and other scheduled or emergency calls. Valley Arbor Care does not guarantee immediate availability or a specific response time unless confirmed in writing.

Cancellations and Rescheduling by the Customer

Customers should notify Valley Arbor Care as soon as possible if they need to cancel or reschedule approved work. Because scheduling involves crew time, equipment planning, routing, and coordination, late cancellations or repeated rescheduling may affect future scheduling availability.

If Valley Arbor Care arrives and cannot perform the work because of customer-controlled conditions, including lack of access, locked gates, blocked work areas, unsafe conditions, or missing permissions, the work may be rescheduled and additional charges may apply if allowed by the applicable proposal or invoice.

Website Use and Content Ownership

The content on this website is provided for general informational purposes only. Unless otherwise stated, website text, images, graphics, logos, service descriptions, and other content are owned by Valley Arbor Care or used with permission. Visitors may not copy, reproduce, modify, distribute, or use website content for commercial purposes without written permission.

Any recommendations, observations, or completed work should not be interpreted as a guarantee of future tree health, safety, growth, survival, or property conditions.

Governing Law

These Terms and Conditions are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles. Any dispute related to website use, services, estimates, proposals, invoices, or these Terms and Conditions will be handled in accordance with applicable Virginia law.

Changes to These Terms and Conditions
